Here is what the Open Division committee is doing. They are keeping all of those teams and anybody else they deem worthy of the Open Division on the watch list until my guess the second to last vote then they will eliminate teams that don't fit the criteria. What has happened in the past couple of years is teams that are on the watch list seem to tank games or lose on purpose so they will not be considered for the Open. Also the Open Division committee has dismissed teams that lost early only to add them back on the watch list later. So they want to keep an eye on everyone just to make sure the best 16 teams make it to the Open Division. As for preparing for the worst, what is wrong with going to the Open Division? I don't get how that could be a bad thing. You automatically qualify for the state playoffs. You only have to play 2 games and you are in versus winning 4 or even 5 games in the divisions to make it to State. Yeah the bottom 4 teams that make it to the Open will probably not be too happy because that means that they probably lost a great opportunity to win a CIF Championship but at least you can go around and brag that you made it into the Open Division and that you are one of the top teams in the Southern Section and also California.
